Three indigenes of Enugu State—Ofor Raphael, Hon. Hypolite Okafor, and Ude Augustina—have filed a fundamental rights enforcement suit against the Nigerian Police at the Enugu State High Court. They are seeking N100 million for their ill-treatment and an additional N10 million in general damages. The plaintiffs allege that their rights were violated through unlawful detentions by the Awgu Division of the Nigerian Police.
The applicants claim that the DPO of Awgu Police Station ordered their arrests in retaliation for petitions they had previously filed against him. They argue that their detentions are unconstitutional and amount to a flagrant abuse of their fundamental rights as provided by the Nigerian Constitution and the African Charter on Human and Peoples’ Rights.
The plaintiffs are demanding the immediate release from detention, citing that their lives are in danger after being held for over a week. The case highlights the ongoing issues of police misconduct and the need for accountability in law enforcement practices.
